1. Who we are
PinSpark is a marketing workflow tool for Etsy sellers, operated by Pinspark ("PinSpark", "we", "us", or "our"), registered in England and Wales. Our registered address is Pinspark, The Pines, BS16 9QY, Bristol, UK.

2. Using PinSpark
PinSpark helps sellers create, organise, schedule, and publish marketing content for products and shops. You must be at least 18 years old and able to enter into a legally binding agreement to use the service.
You are responsible for the information you add to PinSpark, the accounts you connect, and the final review of any content before it is published.
3. Accounts and security
You are responsible for keeping your login details secure and for all activity that happens through your account. Tell us promptly if you believe your account has been accessed without permission.
We may suspend or restrict access if we reasonably believe your account is being misused, compromised, or used in a way that could harm PinSpark, other users, or connected platforms.
4. Plans, billing, and cancellation
PinSpark may offer free and paid plans. Paid plans, prices, usage limits, and included features are shown at the point of purchase or upgrade.
Payments are processed by Stripe. We do not store full payment card numbers. You can cancel a paid plan from your account settings or by contacting us. Cancellation stops future renewals but does not automatically refund past charges unless required by law or expressly stated by us.
5. AI-generated content
PinSpark uses AI tools to help generate listing copy, captions, content ideas, and related marketing materials. AI-generated content may be incomplete, inaccurate, repetitive, or unsuitable for your products or audience.
You must review, edit, and approve all generated content before using, publishing, or relying on it. You are responsible for ensuring your content complies with applicable laws, marketplace rules, advertising standards, intellectual property rights, and platform policies.
6. Connected platforms and APIs
PinSpark may connect with Etsy, Pinterest, Instagram, TikTok, Facebook, X, Stripe, and other third-party services. Your use of those services remains subject to their own terms, policies, API rules, and account requirements.
We are not responsible for changes, outages, restrictions, suspensions, or API decisions made by third-party platforms. You can disconnect connected accounts where supported in your account settings.
7. Your content and shop data
You keep ownership of your product information, shop data, images, generated drafts, edited captions, and other content you add to PinSpark.
You grant us the rights needed to host, process, analyse, generate, display, and transmit that content so we can provide the service to you. This includes passing approved content to connected publishing providers when you choose to publish or schedule posts.
8. Acceptable use
You must not use PinSpark to:
- break the law or encourage unlawful activity;
- infringe intellectual property, privacy, publicity, or other rights;
- publish misleading, harmful, abusive, hateful, or deceptive content;
- attempt to bypass usage limits, security controls, or platform policies;
- reverse engineer, scrape, overload, or interfere with the service;
- upload malware or use PinSpark to send spam.
9. Intellectual property
PinSpark, including its software, design, branding, workflow logic, and documentation, belongs to us or our licensors. You may not copy, sell, sublicense, or exploit the service except as allowed by these terms.
Feedback you provide may be used by us to improve PinSpark without restriction or compensation.
10. Service availability and changes
We aim to keep PinSpark available and useful, but we do not guarantee uninterrupted access. We may update, suspend, remove, or change features where needed for security, legal, platform, or product reasons.
We will try to give reasonable notice of material changes that negatively affect paid users, where practical.
11. Disclaimers
PinSpark is provided on an "as is" and "as available" basis. We do not guarantee that generated content will improve sales, traffic, search ranking, social engagement, or marketplace performance.
Nothing in these terms limits rights or remedies that cannot legally be limited.
12. Liability
We are not liable for business losses, lost profits, lost revenue, lost data, loss of goodwill, platform account restrictions, or indirect or consequential losses arising from your use of PinSpark, except where the law does not allow us to exclude or limit liability.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.
13. Ending your use of PinSpark
You may stop using PinSpark at any time. We may suspend or terminate your account if you materially breach these terms, misuse the service, fail to pay fees when due, or create legal, security, or platform risk.
After termination, provisions that naturally continue will remain in effect, including ownership, liability limits, payment obligations, and governing law.
14. Changes to these terms
We may update these terms from time to time. If we make material changes, we will take reasonable steps to notify you. Continued use of PinSpark after the updated terms take effect means you accept the updated terms.
15. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except where applicable law gives you the right to bring claims elsewhere.
